JOANNAKOMOROWSKA.COM STORE AND WORKSHOP REGULATIONS


§1. DEFINITIONS

In these Regulations, the terms used mean:

  • Store – online store available at joannakomorowska.com, run by Joanna Komorowska, running a business in Warsaw, ul. Belgijska 6/4, NIP 9512173955.

  • Customer / User – a natural person, legal person or organizational unit placing an order in the Store.

  • Goods – all products offered for sale in the Store, in particular clocks, jewellery, candles and other artistic products.

  • Workshops – stationary events of a cultural or educational nature (e.g. kusamono, kokedama, cyanotype, linocut), taking place at a specific date and place.

  • Workshop voucher – a voucher of a specific value or for a specific workshop, valid for 6 months from the date of purchase.

  • Statute – this document.

  • Sales/Reservation Agreement – a contract concluded between the Customer and the Store by placing and paying for an order.


§2. GENERAL INFORMATION

  1. The Store enables the purchase of Goods and the booking of Workshops via the Internet.

  2. The condition for placing an order is to read and accept these Regulations.

  3. Product information (descriptions, prices, photos) constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.

  4. All prices are given in Polish zloty (PLN) and include VAT.

  5. The store reserves the right to change prices, introduce new products and promotions.

  6. In case of price reduction, the Store also provides the lowest price from 30 days before the discount was introduced, in accordance with the Act on Information on Prices of Goods and Services.

  7. The following shall apply to contracts concluded via the Store: Act of 30 May 2014 on consumer rights and Civil Code.


§3. ORDERS

  1. Orders can be placed via the Store website 24 hours a day, every day of the week.

  2. To place an order, the Customer selects a product or workshop, completes the order form and makes the payment.

  3. After placing an order, the customer receives an email confirming its acceptance. At this point, the contract is concluded.

  4. The store reserves the right to refuse to process an order in the event of incorrect data, non-payment or suspicion of abuse.


§4. DELIVERY OF GOODS

  1. Goods are delivered via courier or postal services to the address indicated in the order.

  2. Processing time is usually 1-3 business days from receipt of payment.

  3. The customer should inspect the shipment upon delivery. In the event of damage, a damage report should be completed in the presence of the courier.

  4. The Store is not liable for delays resulting from reasons beyond the Seller's control, in particular the actions of courier companies or payment operators.


§5. PAYMENTS

  1. Payment can be made via:

    • payment cards (Visa, Mastercard, Maestro),

    • electronic systems (SumUp, Przelewy24, PayPal, Blik).

  2. Order processing begins after payment has been received.

  3. All transactions are handled by external payment operators in accordance with their regulations.


§6. WORKSHOPS AND VOUCHERS

  1. Purchasing a place for a workshop in the Store constitutes the conclusion of a contract for the provision of services within a specified period.

  2. No right of withdrawal: Pursuant to Article 38, point 12 of the Consumer Rights Act, the Customer is not entitled to a 14-day right of withdrawal from the contract regarding workshops – these are cultural and educational events with a specific date and time.

  3. Cancellation of workshops: The organizer reserves the right to cancel or reschedule workshops for reasons beyond its control, such as insufficient participants, unforeseen circumstances, or technical or organizational issues. In such cases, the client may transfer their reservation to another date or receive a full refund.

  4. Change of participant: The Client may transfer his/her place to another person free of charge by informing the Organizer by e-mail before the start of the workshop.

  5. Absence: The lack of attendance of a participant does not constitute grounds for a refund of the payment.

  6. Workshop vouchers:

    • are valid for 6 months from the date of purchase,

    • can be used for any workshops available in the Store,

    • cannot be exchanged for cash,

    • If the value of the workshop is higher than the voucher, you can pay the difference.

  7. Invoices: are issued upon request – invoice details must be sent no later than the day of purchase.

  8. Security: Participants agree to adhere to safety rules and the instructor's recommendations. The organizer is not responsible for personal items left in the workshop.

  9. The workshops are intended for individuals aged 16 and over. Participation by younger individuals is only possible with prior arrangement with the Organizer and under the supervision of an adult.
  10. Personal data: the administrator of the data of workshop participants is Joanna Komorowska Studio; the data is processed solely for the purposes of registration, payment and contact.

  11. Image: During the workshops, photos may be taken to document the event. If a participant does not consent to the publication of their image, they should inform the Organizer before the workshop begins.


§7. COMPLAINTS AND RETURNS

Goods

  1. The customer has the right to file a complaint if the Goods are inconsistent with the contract, in accordance with the Consumer Rights Act.

  2. In the first instance, the Store will replace or repair the Goods and, if this is not possible, refund the price.

  3. Complaints should be submitted by e-mail to the following address: joanna@joannakomorowska.com.

  4. The goods should be sent to the following address:
    Joanna Komorowska Studio, Belgijska Street 6/4, 02-511 Warsaw.

Return of goods

  1. A customer who is a consumer may withdraw from the contract for the sale of the Goods within 14 days of receiving them without giving any reason.

  2. The condition is to send information about the withdrawal to the e-mail address: joanna@joannakomorowska.com.

  3. Refunds will be made via the same payment method within 14 days of receipt of the returned product.

  4. Right of withdrawal not applicable:

    • products made to individual order (e.g. jewelry or decorations created according to the customer's specifications),

    • workshops and workshop vouchers (in accordance with §6).

  5. The store does not accept cash on delivery shipments.

  6. The Customer is liable for any reduction in the value of the Goods resulting from their use in a manner that goes beyond what is necessary to establish the nature, characteristics and functioning of the Goods.


§7a. PRODUCT SECURITY (GPSR)

  1. All products offered in the Store are hand-made in Poland by Joanna Komorowska Studio and meet the safety requirements specified in Regulation (EU) 2023/988 of the European Parliament and of the Council of 10 May 2023 on general product safety (GPSR).

  2. Each product is intended for use in accordance with its intended purpose and does not pose a risk to the health or safety of the consumer.

  3. The store ensures that the products are appropriately marked and their packaging contains manufacturer's data enabling identification of the product's origin.

  4. In the event of any defects, damages or hazards related to the use of the product, the Customer may immediately report it to the following e-mail address: joanna@joannakomorowska.com.

  5. The Store undertakes to immediately consider such a report and take action in accordance with the provisions of the GPSR, including – if necessary – withdrawing the product from the market or informing the market surveillance authorities.


§8. PERSONAL DATA AND PRIVACY POLICY

  1. The administrator of personal data is Joanna Komorowska, running a business under the name Joanna Komorowska Studio.

  2. Personal data is processed solely for the purpose of fulfilling orders, booking workshops and contacting the customer.

  3. The customer has the right to view, correct, limit the processing or delete his or her data.

  4. The store uses cookies for statistical and functional purposes; they can be limited in your browser settings.

  5. Data may be transferred to payment operators and courier companies only to the extent necessary to complete the order.


§9. FINAL PROVISIONS

  1. The owner and administrator of the Store is Joanna Komorowska Studio.

  2. Polish law applies to all contracts concluded via the Store.

  3. In matters not regulated by these Regulations, the provisions of the Civil Code and the Consumer Rights Act shall apply.

  4. All disputes will be resolved by the court of competent jurisdiction in accordance with applicable regulations.

  5. The Store reserves the right to make changes to these Terms and Conditions. Changes will not affect orders placed before their implementation date.

  6. All photos, text, and designs available in the Store are protected by copyright. Copying or publishing them without the author's consent is prohibited.

    The regulations are effective from May 14, 2026.
